1. Contract Introduction
1.1 This contract is between you, as the client, and IB5 Limited trading as Tracey Brittain Therapy. It outlines the terms and conditions for the therapeutic services provided. Please review this document carefully.
1.2 If you are requesting therapy for a child, you acknowledge that this constitutes appropriate consent for the therapeutic process.
1.3 If you are an adult, couple, or a parent requesting therapy for a child, this contract applies to you.
1.4 By agreeing to this contract, you accept and agree that Tracey Brittain operates within the ethical guidelines of the BACP, UKCP, and EMDR Association.
2. Assessment
2.1 The initial assessment consultation aims to investigate the key cognitive issues and identify the best therapeutic techniques to be used in the therapeutic process.
2.2 The assessment sessions provide an opportunity to determine whether a shared understanding of your difficulties can be established in a manner that feels meaningful to you. You are not obligated to continue therapy beyond the assessment period. If I believe that a different specialist may better assist you, I may suggest a referral to another practitioner.
2.3 If you have any concerns about the therapy process, please discuss them with me. If either party feels that we are not well-suited for ongoing sessions, the cost of an initial session with a different therapist will be covered as part of the guarantee provided by Tracey Brittain Therapy, provided you contact the admin team. Please note, if you have previously used this guarantee, it may not be available again.
3. Regularity of Sessions
3.1 Once therapy is agreed upon, sessions will be scheduled weekly, with each session lasting 50 minutes. Sessions are arranged either by me or through the online booking system run by Cliniko.
4. Cancellation Policy and Planned Breaks
4.1 If you need to cancel a session, please use the cancellation link provided in all appointment-related emails. Sessions can be cancelled with 48 hours' notice. Failure to cancel within this timeframe or non-attendance will result in a charge for the full fee. Any missed sessions may lead to the forfeiture of your regular slot, and resuming therapy will depend on availability.
4.2 Please discuss any future absences or breaks in therapy with me during a session. If possible, I may be able to offer an alternative slot to accommodate your needs.
4.3 Ad hoc sessions are typically reserved for reviewing progress after a course of therapy. Therapy generally occurs weekly. My availability for additional flexibility is limited due to a full schedule with regular clients.
5. Communication
5.1 If you need to cancel or reschedule, please use the cancellation link sent in all emails regarding your appointments. Note that I am not an emergency service and cannot guarantee that I will notice or respond to communications regarding urgent or emergency situations that could cause harm or death.
6. Payment
6.1 Payment for sessions must be made immediately after the session has been completed. Stripe, Xero, and Cliniko may hold your card details for future payments. GoCardless and Stripe may also hold your data. Interest may be applied daily for late fees, and a £30 administrative fee will be added to chase late payment fees.
6.2 You are responsible for ensuring that the email address used for correspondence and bookings is active and checked regularly. By using this email, you agree that any correspondence sent to this address is legally binding, and you are responsible for any fees related to appointments.
7. Therapist Absences
7.1 I will provide as much notice as possible regarding my holidays and any unforeseen absences, which will be kept to a minimum. You will not be charged for my absences.
8. Arrival and Late Attendance
8.1 Please arrive at the exact appointment time. If you have a child in therapy and are late to pick them up, you may be liable for an additional session. Unfortunately, I cannot make up time for late arrivals.
9. Safety
9.1 To ensure the effectiveness of therapy, please do not arrive under the influence of alcohol or non-prescribed drugs. If I have reason to believe this is the case, I may end or not commence the session.
9.2 Therapy may evoke strong emotions, and in rare instances where these emotions become unmanageable, I may end the session early.
9.3 If there are concerns regarding your safety or the safety of others, including myself, I may need to inform other agencies. Please refer to section 11, Confidentiality.
9.4 I do not offer emergency support and cannot guarantee my availability. If you are in danger, please contact emergency services, your GP, or the Samaritans, and discuss this with me in our next session.
10. Ending Therapy
10.1 Therapy is not a "quick fix," and you are expected to share responsibility for your progress. If you feel therapy is no longer beneficial or meaningful, please discuss this with me.
10.2 If either party decides it is time to end therapy, we will discuss how to conclude the therapeutic relationship. Please provide as much notice as possible if you decide to terminate therapy.
10.3 If I need to discontinue therapy and you wish to be referred to another therapist within Tracey Brittain Therapy, I will respect your decision. I will maintain responsibility for your records until they are securely disposed of, as per professional and legal requirements.
11. Confidentiality
11.1 All sessions are conditionally confidential. However, I am legally obliged to:
- Inform appropriate agencies if I perceive you are a danger to yourself or others.
- Share information if required by a court order or by law.
- Disclose information for the prevention, detection, or prosecution of a crime.
11.2 These situations are rare, and I will usually inform you if I need to act in this way.
11.3 By signing this agreement and/or continuing with therapy, you consent to me holding your assessment information and other information provided during our work together. I will maintain this information in accordance with the Data Protection Act 2018, clinical governance standards, and other relevant legislation.
11.4 By signing this agreement and/or continuing with therapy, you also consent to Tracey Brittain Therapy, Cliniko, Stripe, GoCardless, and any other relevant service providers holding and processing your personal data, including but not limited to contact details, bank details, and sensitive data related to your health and identity. This data may be transferred outside the European Economic Area.
12. Extra Work Undertaken
12.1 If you request reports or letters, my time spent preparing such documents will be charged at my hourly rate. Please inform me in advance if you require professional documentation or if therapy is related to a legal claim.
13. Contract
13.1 The contract is between you and IB5 Limited trading as Tracey Brittain Therapy. Harley Therapy Platform is not liable for any advice or treatment provided.
14. Insurance
14.1 As an independent practitioner, I hold professional indemnity insurance.
15. Complaints
15.1 It is natural to experience feelings of frustration or dissatisfaction about the therapy process; these should be discussed with me as described earlier (please refer to section 10.0).
15.2 Should you have a complaint about my conduct that we have been unable to resolve to your satisfaction, or if you believe it is serious enough to escalate directly to my professional body, you may contact them.
15.3 Complaints about the booking system, website, or app should be directed to Tracey Brittain Therapy. They are not able to address issues related to our relationship or my conduct, and if you approach them, they will advise you to either speak to me or contact my professional body.
15.4 Please direct complaints concerning technical matters to Tracey Brittain Therapy in writing, providing as much detail as possible. Complaints should be addressed to the Clinical Director, Tracey Brittain Therapy, either by email at admin@emdrharleyst.com or by post at Chirnel, Weymanor Road, New Haw, Surrey, KT15 3JW. They will endeavour to resolve your concern and will normally respond within 10 working days.
16. Recommendations and Advice
16.1 During therapy, I may make recommendations for you to consider. These are advisory only, and you should seek further advice before acting on them. Any instructions provided are also advisory and should not be viewed as directives.
17. Confidentiality of Communications
17.1 If, by accident, I or my administrators communicate details pertaining to another client through any means, you are obligated to notify me immediately and delete the communication. I accept no liability for such occurrences.
18. Use of Therapy Animals
18.1 At times, therapy may involve the use of therapy animals (a dog and cats). In rare situations, these animals may bite or injure a client. I accept no responsibility for any such incidents.
19. Communication
19.1 You should not send confidential information to me via unsecured methods. If you choose to do so, whether by email or any other method, you do so at your own risk. If I acknowledge or respond to this information, I do not accept liability for the unsecured method used.
20. Termination of Therapy
20.1 I may terminate therapy at any point and for any reason. If I choose to terminate therapy, I will inform you, and we will work towards a conclusion of the therapeutic relationship.
